Florist Stockwell E-commerce Terms & Conditions
Scope of Terms and Territorial Coverage
These Terms & Conditions (“Terms”) govern all online purchases and deliveries made through Florist Stockwell’s e-commerce platform. By placing an order for flower delivery in Stockwell or any surrounding area, you (“the customer”) agree to abide by these Terms. Our services are available to private and business customers located within Stockwell and adjacent postcodes, including, but not limited to, Brixton, Clapham, Kennington, and Vauxhall. Please read these Terms carefully before placing an order. If you have any queries, review these sections in detail before making a purchase.
The Order Process
You may purchase flowers and related products via our online store. To complete an order, you must add selected products to your online shopping basket and proceed to the checkout. During checkout, you will be asked to provide essential information, including recipient details, delivery address, and preferred delivery date. Please review all information for accuracy before confirming your order.
After submitting your order, you will receive an order confirmation on-screen and, where provided, via email. This confirmation summarises your chosen products and delivery details. Please note, confirmation of receipt does not equate to formal acceptance of your order. Formal acceptance occurs once payment is received and we have verified that the requested products are available for delivery to the specified location, within your selected date and time frame.
Occasionally, we may be unable to fulfil all or part of an order due to factors such as stock shortages, limitations on deliveries to certain addresses, or extreme weather conditions. In such cases, we will contact you directly to discuss alternatives or process a full or partial refund.
Payments
Florist Stockwell accepts payments by credit card, debit card, and additional payment methods as clearly displayed at the checkout stage. All transactions are processed in pounds sterling (£ GBP) and include applicable UK VAT.
Full payment must be completed at the point of order. We use secure third-party payment processors for online transactions. Your financial details are handled in accordance with industry best practices and applicable UK law.
Should a payment be declined or otherwise fail to process, your order will not be accepted or fulfilled. You are responsible for ensuring that your payment details are correct and up to date before order submission. Where applicable, payment for business clients may be subject to alternative arrangements as expressly agreed in writing in advance.
Cancellations and Amendments
You may cancel or amend your order at any point prior to order processing and dispatch. Please contact us as soon as possible if you wish to modify or cancel an order. If your order has already been prepared or dispatched, cancellation or amendment may not be possible, and you may be liable for the full amount charged.
For orders cancelled before preparation begins, a full refund will be issued. Should the need arise for Florist Stockwell to cancel your order (e.g., stock unavailability or delivery impossibility), you will be notified promptly and entitled to a full refund or, if preferred, an alternative product or rearranged delivery.
Due to the perishable nature of floral products, the Consumer Contracts Regulations 2013 (UK) relating to distance selling do not provide an automatic right to cancel floral purchases once processing has begun. Nonetheless, we always endeavour to be fair and will review requests on a case-by-case basis.
Deliveries
Florist Stockwell strives for timely delivery to all addresses in Stockwell and neighbouring areas specified at checkout. Standard delivery is offered on a same-day or next-day basis, depending on the time and date the order is placed. Exact delivery slots and timescales will be confirmed at checkout, though all times are estimates and not guaranteed.
You are responsible for ensuring that the recipient's address and any necessary access instructions are accurate and complete. Florist Stockwell is not liable for failed or delayed deliveries caused by incorrect or incomplete information supplied by the customer.
Should the recipient be absent at delivery, we will follow your chosen instructions (such as 'leave with neighbour' or 'safe place'). Where such instructions have not been provided, we may attempt re-delivery or contact you for further direction; however, some additional fees may apply. If re-delivery is not possible, the bouquet will be returned to us and may not remain in optimal condition.
Products & Substitutions
We endeavour to supply all flowers and arrangements exactly as displayed and described on our website. However, flowers are natural products subject to seasonal and regional availability, and substitutions of similar type, equal or greater value and aesthetic may sometimes be necessary. Where practical, we will contact you to approve any significant changes; however, minor substitutions to ensure freshness and continuity may occur without notice.
Specific requests regarding flower types, colours, or arrangements will be accommodated where possible, but cannot always be guaranteed.
Returns, Refunds & Quality Concerns
If you are not satisfied with your order or if products arrive damaged or in substandard condition, please notify us within 24 hours of delivery. When possible, please provide photographic evidence. After verifying your concern, we may offer replacement, partial refund, or full refund at our discretion.
Because flowers are perishable, we cannot accept returns unless flowers were delivered damaged or not as described (excluding minor substitutions as outlined above).
Customer Responsibilities
By placing an order, you confirm that all information provided is accurate and that you have the legal right to use any payment method supplied. You further agree to take responsibility for ensuring that recipients are available to accept delivery, or that suitable arrangements have been made for receipt of the flowers. You agree not to use our service for unlawful purposes, including the transmission of abusive or discriminatory messages with your bouquet.
Liability
Florist Stockwell will not be liable for: (a) any indirect or consequential loss; (b) any loss arising from incorrect information provided by the customer, or (c) delay or non-performance caused by circumstances beyond our reasonable control, including but not limited to adverse weather, public events, or third-party delays.
Our liability for any claim arising in connection with your order shall in any event be limited to the price paid for that order.
Intellectual Property
All content, designs, images, and branding displayed on the Florist Stockwell website and associated materials are the property of Florist Stockwell or our licensors. You may not use, reproduce, or distribute any content from our site for commercial purposes without prior written consent.
Data Protection & Privacy
Florist Stockwell is committed to protecting your privacy in accordance with the Data Protection Act 2018 and the UK GDPR. Our privacy practices are outlined in our separate Privacy Policy, available on our website. We collect and use your personal data only as necessary to process and fulfill your order and to improve our services.
We never sell your details to third parties but may share essential information with our trusted delivery partners for fulfillment purposes.
Changes to These Terms
We reserve the right to update or amend these Terms to comply with applicable laws or address changes in our business processes. Any changes will take effect immediately upon posting to our website. It is your responsibility to review these Terms before making an online purchase.
Governing Law and Jurisdiction
All contracts for the sale and delivery of flowers from Florist Stockwell are governed by the laws of England and Wales. Any dispute or claim arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Entire Agreement
These Terms constitute the entire agreement between you and Florist Stockwell regarding the supply of products ordered online. No other terms, oral or written, are binding unless expressly agreed.
